Employers Of Manufacturing Units/Factories In Puducherry To Provide Paid Medical Leave And Not Terminate Services Of Workers Who Test COVID-19 Positive

The Government of Puducherry vide notification no. 104/PSEC/COVID-19/2021 has enforced corona night curfew from 10.00 pm till 5 am up to 31st May 2021. In furtherance of the above order, terms and conditions for operations of industries are issued in addition to the list of permitted and restricted activities.

The factories/manufacturing units must ensure adherence to the below guidelines issued,

(1) If a worker is found positive, other workers who have been in contact with the him will be quarantined with pay.

(2) In any case, if a worker is found positive, the unit should be closed until completely sanitized.

(3) If a worker is found positive, he/she would be allowed medical leave and cannot be discontinued during their absence for this reason

(4) Common toilet facilities must be sanitized frequently.

Hence, employers are requested to ensure compliance as per the notification and direction issued in accordance with the guidelines for the list of permitted areas, restricted activates and ensure adherence to appropriate COVID behavior along with National Directives.

Extension Of Working Hours For Essential Commodities, Pharmaceutical Factories In Uttarakhand

Government of Uttarakhand vide notification no No.VIII-1/21-91(Labour)/2008-TC-II(2) has exempted provisions of Section 51 (Weekly Hour), Section 54 (Daily Hour), Section 55 (Intervals For Rest), Section 56 (Spread over Hours) for factories relating to essential commodities, pharmaceutical manufacturers due to COVID-19 pandemic in Uttarakhand subject to aforesaid conditions,

(1) In all the industries mentioned above, work can be done in two shifts of twelve to twelve hours per day for a production unit. Four hours per day of overtime shall be paid according to the rules,

(2) Workers working in both these units will work maximum days in a week, and the limit of overtime will be twenty-four hours per week.

(3) The extension of work will be determined in such a way that every worker will be given thirty minutes rest after six hours.

(4) Employees shall not be laid off by the employer during this period.

(5) The labour commissioner will ensure that the said emergency provisions are not used by any factory continuously.

(6) This notification will remain in effect for sixty days from the date of issue and it will be automatically neutralized after the said period.

Notification:-Extension Of Working Hours For Essential Commodities, Pharmaceutical Factories In Uttarakhand 

Draft Code On Social Security (Employee's Compensation) (Central) Rules, 2021

Ministry of Labour vide notification no G.S.R. 385(E) has notified the draft Code On Social Security (Employee' s Compensation) (Central) Rules, 2021 for providing compensation to workers under the Code on Social Security, 2020.

The proposed draft Rules will supersede the Employee’s Compensation Rules, 1924, the Employee’s Compensation (Transfer of Money) Rules, 1935 and the Employee’s Compensation (Venue of Proceedings) Rules, 1996 under the erstwhile Employee’s Compensation Act, 1923.

The Act has been repealed by section 164 of the said Code on Social Security, 2020 passed by the Parliament in September 2020.

As per the new rules, if the amount of compensation payable under sub-section (3) of section 77 is not paid by the employer within the period of thirty days, the employer shall pay, from the date on which the compensation become payable to the date on which it is paid, simple interest at the rate of 12% per annum or any other rate notified by the Central Government from time to time.

Further, it has also notified Rules to give effect to arrangements with other countries for the transfer of money paid as compensation under section 159 of the Code.

When any sum is transmitted by any authority in India to any other authority in accordance with these rules, the costs of such transmission may be deducted from the sum so transmitted and such money shall be transmitted by remittance transfer receipt or by money order.

It further stated that when the whole or any part of a lump sum deposited with a competent authority for payment as compensation under the Code is payable to any person or persons residing or about to reside in any other country, the competent authority may order the transfer to that country of the sum so payable.

ESIC COVID-19 Relief Scheme

The ESIC vide notification no. P-11/14/11/ COVID-19 Relief Scheme/2021-Bft- II has approved ESIC COVID-19 Relief Scheme to provide help to the families of the Insured Persons who died due to Covid-19.

The dependent of insured person are entitled to receive 90% of the Average Daily Wages of the Insured persons during their life and will be paid periodically.

For the dependents to receive the benefits, the insured person should have been registered on the ESIC portal at least 3 months prior to diagnosis of COVID resulting in death.

Also, the Insured person must have been employed for wages and contribution for 78 days should have been paid or payable in respect of deceased insured person during a period of one year preceding the death.

The scheme shall be effective for a period of two years w.e.f. 24.03.2020.

Enforcement Of Provisions Towards ESIC In Madurai Districts Of Tamil Nadu

The Payment Of Gratuity (Gujarat) (Amendment) Rules, 2021

The Government of Gujarat vide notification no. GHR/2021/22/LBL/192020/510460/M3 has deleted provision towards Rule 4 (display of notice) and Rule 19 (display of abstract of the act and rule) respectively.

Hence, the employers registered under the Act in the state of Gujarat may make note of this amendment and comply accordingly.

Amendment To Working Hours For Opening Of Shops And Establishments 24*7 In Karnataka

Government Of Karnataka vide notification No.E-LD 4 LET 2019 (p) has amended para 4 of the previous notification published on 2nd January 2021.

As per the amendment, the working hours has now been amended to nine hours (instead of eight hours) on any day and forty-eight hours in any week with condition that the total number of hours of work including overtime shall not exceed ten hours in any day and the total number of overtime hours worked by an employee does not exceed fifty hours in a period of three continuous months.

Notification:-Amendment To Working Hours For Opening Of Shops And Establishments 24*7 In Karnataka

The Goa Factories (Fifteenth Amendment) Rules, 2021

The Government of Goa vide notification no. VI/FAC-6(L-1)Part-1/IFB-2020/975 has amended provision towards competent person, approval of plans, use of premises as a factory, certificate of stability, application for registration, renewal of license, mode of payment of fees, medical examination of workers, Latrine accommodations, pressure vessels or plant, medical examination, occupational health centre, qualifications of supervisors, dangerous manufacturing process and other schedules under The Goa Factories Rules, 1985.

The brief of amendments mentioned below,

(1) The fees towards application of competent person has been increased from ten thousand to twenty thousand,

(2) Clause inserted towards approval by Chief Inspector for existing building/shed/structure/work of engineering construction, 

(3) The person issuing certificate of stability shall be a structural engineer instead of competent person,

(4) The application for registration and license shall be accompanied with fees as replaced,

(5) The renewal of license shall be made through online mode, within three months including fees shall be paid through e-challan payment gateway,

(6)The mode of payment of fees shall be online through e-challan payment gateway under the said head of account

 (7) The amendments also includes insertion of new rule towards arrangements of personal protective equipment.

As per the Notification No DES/859/2021-P3(1), the Consumer Price Index (Cost of Living Index) Numbers applicable to employees in employment under the Minimum Wages Act (Central Act XI of 1948) for the month of May 2021 ascertained by the Director-General of Economics & Statistics under clause (C) of Section 2 of the Act.
